Separation and Divorce

We structure the Separation and Divorce Mediation process to meet the needs and goals of each couple, allowing you to make your own choices for resolving the problems you face in your own separation or divorce.  Mediation may cover all or some of the following:

Equitable Distribution or Division of Property.  The process will help you decide how to divide your assets, which may include bank accounts, stocks and mutual funds, co-ops and condominiums, real estate, cars, artwork and other collectibles, and other assets that are considered marital property. For professionals and business owners, Mediation will help you address the value of professional licenses and degrees as well as entrepreneurial businesses and practices, such as accounting and medical practices and closely-held companies.

Retirement Assets. Where appropriate, the Mediator will help you choose how to deal with retirement or retirement assets, such as pension plans, 401K Plans, and deferred compensation plans, accumulated during your marriage.

Parenting Arrangements.  The Mediation Process will help you discover and discuss your options about parenting your children. Together we will work to give you choices about spending time with your children and about making important decisions about their education and their healthcare.  In the Mediation Process, you can create a schedule of the times that each parent will spend with your children, and how you will share vacations, holidays and other special days.

Child Support.  The Mediator will help you identify your best, workable solutions to provide support for raising your children from their early years through college.

Finances and Planning for Life after Separation and Divorce.  Separation and divorce creates special financial problems. If nothing else, one household becomes two after separation or divorce.  Mediation will help you address the challenges of adjusting to the requirements of two households; paying for childcare, health and other insurance; and educational needs.

Family Mediation

The Mediation Process can help families deal with the complex emotional and financial issues involved in Elder Care, in caring for a family member’s Long Term or Chronic Illness or even in resolving disputes among heirs to an estate.

Post-Divorce Mediation can help resolve Custody, Parenting, Financial and other issues that arise, sometimes many years, after divorce.

Business and Commercial Mediation

Mediation can help partners and business associates resolve Business and Commercial Disputes and Conflicts.

Other Professionals

Other Professionals.  As appropriate, the mediator will refer couples to expert advice or services, such as accountants, valuation experts, financial planners, pension experts or attorneys.  If you are already engaged in a mediation, as a licensed New York attorney, I can consult with you and prepare necessary agreements and documents, and process the legal filings to obtain an uncontested New York Divorce.
